RELATING TO THE GENERAL ASSEMBLY -- COMPOSITION OF THE SENATE | |

It is enacted by the General Assembly as follows: | |

     SECTION 1. Sections 17-14-1.2 and 17-14-2 of the General Laws in Chapter 17-14 |
1-2 |
entitled "Nomination of Party and Independent Candidates" are hereby amended to read as |
1-3 |
follows: |
1-4 |
     17-14-1.2. Candidate required to be a qualified voter in the election. – (a) No person |
1-5 |
shall be eligible to file a declaration of candidacy as an independent candidate nor shall a person |
1-6 |
be eligible to be a candidate or be eligible to be voted for unless the person shall, at the time of |
1-7 |
filing the declaration, be qualified to vote in the election within the district for the office which |
1-8 |
that person seeks. |
1-9 |
     (b) Notwithstanding any other provision of this section, individuals residing in state |
1-10 |
senate districts 1, 2, 3, 4, 5, 6, 7, 8, 14, 15, 16 and 17 may file a declaration of candidacy for state |
1-11 |
senator and/or senatorial district committee member for those senate districts for the 2004 |
1-12 |
election pursuant to section 17-14-1, provided they were registered to vote in the election for that |
1-13 |
district on or before June 16, 2004. |
1-14 |
     17-14-2. Candidate required to be a qualified voter in the primary. – (a) No person |

     SECTION 2 Section 22-1-2 of the General Laws in Chapter 22-1 entitled "Composition |
2-6 |
of Senate" is hereby amended to read as follows: |

     22-1-2. Districts. -- The state is hereby divided into thirty-eight (38) senatorial districts |
2-8 |
bounded and described as follows: |
2-9 |
      (1) It is understood and intended that for the purpose of this section a line described as |
2-10 |
running on, along, to or through any street (including road, avenue, lane, way, parkway, |
2-11 |
expressway, divided highway, state route or interstate route, or trail), stream or river, is intended |
2-12 |
to mean the center line of that street, stream or river, in all instances, unless it shall be otherwise |
2-13 |
specified. |
2-14 |
      (2) It is further understood and intended that for the purpose of this section, the districts |
2-15 |
described in this section shall be composed of United States census geography (tracts and blocks), |
2-16 |
as defined by the 2000 version of the "TIGER" files from the United States Census Bureau, |
2-17 |
whose boundaries correspond to the below metes and bounds set forth in this section and which |
2-18 |
are hereby made a part of this chapter. A listing of which census blocks are contained within each |
2-19 |
district shall be deemed to be incorporated by reference. |
2-20 |
      (3) (i) It is further understood and intended that for the purpose of this section, the |
2-21 |
districts will be depicted on thirty-nine (39) maps, compiled by Election Data Services, Inc. for |
2-22 |
each city and town, and hereinafter may be referred to as town maps. |
2-23 |
      (ii) The secretary of state shall keep a copy of each set of the foregoing maps and a copy |
2-24 |
of the census tract and block listing available for inspection during ordinary business hours at his |
2-25 |
or her office. The secretary of state shall furnish each city and town a copy of the town map |
2-26 |
covering that particular city or town within ten (10) days from the passage of this act. |
2-27 |

2-28 |
      (iii) For purposes of this title, references to "tract" or "CT" shall mean "census tract", as |
2-29 |
that demographic unit is established by the United States Bureau of the Census for the 2000 |
2-30 |
census as described by maps and publications of the bureau. References to "block", "blocks", |
2-31 |
"block groups", "enumeration district", or "enumeration districts", refer to those demographic |
2-32 |
units as established by the United States Census Bureau for the 2000 census as described by maps |
2-33 |
and publications of the bureau. |
2-34 |
      (iv) Any reference to a "city or town", "city or town boundaries", or "city or town limits" |
3-1 |
shall refer to the boundaries or limits of the particular city or town as they existed on January 1, |
3-2 |
2000. |
3-3 |
      (v) In the census tract and block listing, the first two (2) digits of a census description |
3-4 |
shall refer to the state of Rhode Island (44), the next three (3) digits of a census description shall |
3-5 |
refer to the county in which the district lies. Bristol county carries the code 001; Kent county |
3-6 |
carries the code 003; Newport county carries the code 005; Providence county carries the code |
3-7 |
007 and Washington county carries the code 009. The next six (6) digits refer to the census tract |
3-8 |
within the county set forth in the description. The last four (4) digits refer to the census block |
3-9 |
within the census tract. "TIGER" is an acronym for the computer readable geographic data base |
3-10 |
that automates the mapping and related geographic activities required to support the United |
3-11 |
States' Census Bureau's census and survey programs and stands for "Topologically Integrated |
3-12 |
Geographic Encoding and Referencing." |
3-13 |
      (vi) If any census tract, block, block group, or enumeration district is omitted, listed |
3-14 |
more than once, or is only partially provided for, it is intended that the districts be defined in such |
3-15 |
a manner as to not omit any area of Rhode Island from a district and to comply with the standard |
3-16 |
of Articles VII and VIII of the Rhode Island Constitution requiring that districts be reasonably |
3-17 |
equal. In order to carry out the intent of the general assembly as expressed in this section the |
3-18 |
secretary of state, shall if necessary, undertake measures to insure compliance with this section. |
3-19 |
      (vii) In the event of a discrepancy between the metes and bounds description, the |
3-20 |
description of census tracts and blocks, and the maps which shall be on file with the secretary of |
3-21 |
state, then the listing of census tracts and blocks shall take precedence and be controlling. |

     SECTION 3. The senatorial committees of the senatorial districts 1, 2, 3, 4, 5, 6, 7, 8, 14, |
34-30 |
15, 16 and 17 in office on the effective date of this act shall not thereafter exercise any powers of |
34-31 |
nomination or endorsement of candidates for senator, but the chairperson of the state committee |
34-32 |
of each political party, forthwith upon passage of this act, shall appoint the members of a |
34-33 |
senatorial district committee for each of those enumerated senatorial district. Each of said |
34-34 |
senatorial district committees shall consist of five (5) members except that in senatorial districts |
35-1 |
which include all or parts of two (2) or more cities or towns, the committee shall consist of seven |
35-2 |
(7) members. Such district committee members, so appointed, shall hold office until the primary |
35-3 |
elections in 2004 and thereafter until their successors shall have been duly elected, qualified and |
35-4 |
organized. Nothing herein contained shall be construed to vacate the office or terminate the term |
35-5 |
of office of any state committee member of any party prior to the party primary election in |
35-6 |
September, 2004. |
35-7 |
     SECTION 4. Wherever in the general laws or in any public law a duty is imposed upon |
35-8 |
the president of a town council or upon the local board of any city or town or upon a town clerk, |
35-9 |
town sergeant or constable in connection with the election of a senator such duty in the case of a |
35-10 |
senatorial district comprising parts or the whole of more than one (1) town shall be deemed to be |
35-11 |
imposed upon the president of the town council or local board or town clerk, town sergeant or |
35-12 |
constable of each or all of the towns in which such senatorial district shall lie. Wherever in the |
35-13 |
general laws or in any public law a duty is imposed upon the city committee, town committee, or |
35-14 |
ward committee of a political party in connection with the election of a senator, such duty shall be |
35-15 |
deemed to be imposed upon the senatorial district committee of the party as the context shall |
35-16 |
require. |
35-17 |
     SECTION 5. Wherever in the general laws or in any public law reference is made to a |
35-18 |
senator from any city or town, or to the election of a senator from any city or town, such |
35-19 |
reference shall mean and be deemed to refer to a senator from a senatorial district, or the election |
35-20 |
of a senator from a senatorial district, as the context may require. |
35-21 |
     SECTION 6. This act shall be liberally construed to effectuate the purposes thereof and |
35-22 |
to apportion the state into senatorial districts in compliance with the requirements of the United |
35-23 |
States Constitution. It is intended that the senatorial districts described herein completely |
35-24 |
encompass all the area within the state and contain all the population residing in the state. It is |
35-25 |
further intended that the apportionment and districting provided for in this act results in the |
35-26 |
creation of districts containing substantially equal population. It is also intended that no senatorial |
35-27 |
district shall include any of the area included within the description of any other senatorial |
35-28 |
district. If the districts described in this act do not carry out the purposes thereof because of patent |
35-29 |
unintentional omissions, duplications, overlapping area, erroneous nomenclature, faulty |
35-30 |
description of boundary lines, street closings, changes in names of streets or of public places, |
35-31 |
alteration of the courses of rivers or streams, the filling in of lands under water or changes in |
35-32 |
shorelines due to accretion, the secretary of state is hereby authorized and empowered to correct |
35-33 |
such omissions, overlaps, erroneous nomenclature, or other defects in the description of districts |
35-34 |
so as to accomplish the purposes and objectives of this act. In making such corrections, the |
36-1 |
secretary of state shall be guided by the following standards: |
36-2 |
     (1) gaps in the description of any district shall be completed in a manner which results in |
36-3 |
a total description of the district in manner consonant with the description of adjacent districts; |
36-4 |
     (2) areas included within the descriptions of more than one (1) district shall be allocated |
36-5 |
to the district having the lowest population; |
36-6 |
     (3) areas not included within the descriptions of any district shall be allocated to the |
36-7 |
adjacent district having the lowest population. |
36-8 |
     SECTION 7. This act shall take effect upon passage; provided, however that the |
36-9 |
provisions hereof shall first be effective in connection with elections to be held on or subsequent |
36-10 |
to the first day of September, 2004, and for the purpose of greater clarity, the first election under |
36-11 |
the provisions of this act for senator from each of the twelve (12) senatorial districts hereby |
36-12 |
revised shall be held on the Tuesday next after the first Monday in November, 2004, and the first |
36-13 |
primary election under the provisions of this act for nomination of candidates for senator from |
36-14 |
each of said senatorial districts shall be held on the second Tuesday after the first Monday in |
36-15 |
September, 2004; provided, however, that if any provision of this act or the application of such |
36-16 |
provision to any person or under any circumstances shall be held unconstitutional or otherwise |
36-17 |
invalid or inoperative by a decision of any court of competent jurisdiction, or if any action |
36-18 |
performed or to be performed under any provision of this act is restrained or enjoined by any |
36-19 |
court of competent jurisdiction, the remaining provisions of this act shall not be deemed to be |
36-20 |
impaired or affected thereby but shall be deemed to remain in full force and effect. Any primary |
36-21 |
or special election held prior to the first day of September, 2004, shall be conducted under the |
36-22 |
laws as they existed prior to the passage of this act. |
