RELATING TO EDUCATION - KINDERGARTEN

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 16-2 of the General Laws entitled "School Committees and

Superintendents" is hereby amended by adding thereto the following section:

     16-2-28.3. Kindergarten -- Hours of instruction -- School day. -- Notwithstanding any

provisions of the general or public laws or rule or regulation to the contrary, a kindergarten

1-5

school day must contain at least five and one-half (5½) hours (three hundred thirty (330) minutes)

of actual school work excluding lunch, recess periods, common planning time, pre and post

1-7

school teacher time, study halls, homeroom periods, student passing time and any other time that

1-8

is not actual instructional time. Student advisory periods may be counted as instructional time.

The commissioner has discretion to decide whether other school programs may be counted as

1-10

instructional time.

     SECTION 2. This act shall take effect upon passage.
