It is enacted by the General Assembly as follows: | |

     SECTION 1. Chapter 37-8 of the General Laws entitled "Public Buildings" is hereby |

amended by adding thereto the following section: |

     37-8-20. Motorcycle designated parking at public buildings. – (a) In order to |
1-4 |
encourage and/or accommodate motorcycle parking and to assure, whenever possible, that |
1-5 |
designated parking spaces for motorcycles are provided in parking areas adjacent to, or within |
1-6 |
sight of, state, city, and town buildings, every state department or state agency and every agency |
1-7 |
or institution maintained by a Rhode Island city or town is required to prepare a motorcycle |
1-8 |
parking plan. Provided, however, airports within the state are not required to comply with this |
1-9 |
requirement. |
1-10 |
     (b) Motorcycle parking plans shall initially be prepared prior to November 1, 2012, and |
1-11 |
shall be promptly posted on the applicable website of the state, city, or town. In the event that a |
1-12 |
new state, city, or town building is constructed, a motorcycle parking plan shall be in effect |
1-13 |
within thirty (30) days that the building is open to the public. |
1-14 |
     (c) Each motorcycle parking plan shall include, but not be limited to, the following |
1-15 |
provisions: |
1-16 |
     (1) Wherever possible, designated parking spaces for motorcycles shall be provided in |
1-17 |
parking areas that are adjacent to, or within sight of, state, city, and town buildings; |
1-18 |
     (2) The number and placement of designated motorcycle parking spaces shall be |
1-19 |
determined as a result of motorcycle utilization by employees of state, city, and town buildings, |
2-20 |
     and with input from motorcycle owners; |
2-21 |
     (3) Designated motorcycle parking places must be set aside and made available annually |
2-22 |
to state employees during the months of April through November, beginning on April 1, 2013; |
2-23 |
and |
2-24 |
     (4) Signage designating motorcycle parking spaces shall be in place by April of each |
2-25 |
year. |
2-26 |
     (d) Motorcycle parking plans may be revised as situations warrant, but must be reviewed |
2-27 |
at least once every five (5) years and revised, as necessary. |
2-28 |
     (e) The unauthorized use of a designated motorcycle parking space will result in a fine |
2-29 |
against the registered owner of the offending vehicle in the amount of eighty-five dollars |
2-30 |
($85.00). |
2-31 |
     SECTION 2. This act shall take effect upon passage. |
