A N A C T

RELATING TO PUBLIC UTILITIES AND CARRIERS -- PUBLIC TRANSIT AUTHORITY

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 39-18 of the General Laws entitled "Rhode Island Public Transit

Authority" is hereby amended by adding thereto the following sections:

     39-18-25. Limitations of damages. -- In any tort action against the authority, its

members and/or its employees acting in their official capacity, any damages recovered therein

1-5

shall not exceed the sum of one hundred thousand dollars ($100,000).

     39-18-26. Damages in excess of limitation. -- The general assembly may, by special act,

1-7

authorize actions of tort against the authority, its members and/or its employees acting in their

1-8

official capacity, in particular cases in which the amount of damages to be recovered may exceed

1-9

one hundred thousand dollars ($100,000).

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would limit damages to one hundred thousand dollars ($100,000) in any tort

action against the public transit authority except in cases where the general assembly may

authorize tort action in excess of that amount.
