RELATING TO BUSINESSES AND PROFESSIONS - HOME INSPECTORS | |

It is enacted by the General Assembly as follows: | |

     SECTION 1. Sections 5-65.1-4 and 5-65.1-5 of the General Laws in Chapter 5-65.1 |

entitled "Home Inspectors" are hereby amended to read as follows: |

     5-65.1-4. Eligibility for licensure as home inspector. -- (a) To be eligible for licensure |
1-4 |
as a home inspector, an applicant shall fulfill the following requirements: |

      (1) Be of good moral character; |
1-6 |
      (2) Have successfully completed high school or its equivalent; |
1-7 |
      (3) Have been engaged as a licensed associate home inspector for no less than one year, |
1-8 |
and have performed not less than one hundred (100) home inspections for compensation, or have |
1-9 |
been a registered/licensed contractor in good standing in any state for an aggregate of not less |
1-10 |
than five (5) years; and |
1-11 |
      (4) Have passed an examination approved or administered by the board. The |
1-12 |
examination may have been passed before the effective date of this chapter. |
1-13 |
      (b) After the effective date of this chapter the board shall issue a license to any person |
1-14 |
upon application, provided that the applicant meets: |
1-15 |
      (1) The requirements of subdivisions (a)(1), (2) and (4) of this section, and either: |
1-16 |
      (i) Has been engaged in the practice of home inspections for compensation for not less |
1-17 |
than one year prior to the effective date of this chapter and has performed not less than one |
1-18 |
hundred (100) home inspections for compensation prior to the effective date of this chapter; or |
1-19 |
      (ii) Is a registered/licensed contractor in good standing in any state for an aggregate of |
1-20 |
not less than five (5) years; or |

      (2) The requirements of subdivisions (a)(1) and (2) of this section, and has been engaged |
2-2 |
in the practice of home inspections for compensation for not less than two (2) years and |
2-3 |
performed not less than one hundred fifty (150) home inspections for compensation prior to |
2-4 |

2-5 |
     5-65.1-5. Eligibility for licensure as associate home inspector. -- (a) To be eligible for |
2-6 |
licensure as an associate home inspector, an applicant shall fulfill the following requirements: |
2-7 |
      (1) Be of good moral character; |
2-8 |
      (2) Have successfully completed high school or its equivalent; |
2-9 |
      (3) Have assisted in not less than fifty (50) home inspections in the presence of a |
2-10 |
licensed home inspector; and |
2-11 |
      (4) Have passed an examination approved or administered by the board. The |
2-12 |
examination may have been passed before |
2-13 |
     SECTION 2. This act shall take effect upon passage. |
