RELATING TO CRIMINAL PROCEDURE - BAIL AND RECOGNIZANCE

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 12-13 of the General Laws entitled "Bail and Recognizance" is

hereby amended by adding thereto the following section:

     12-13-5.3. Habitual offenders – Crimes of violence against women and children. --

Any person who is deemed to be a habitual offender and commits a crime of violence against

1-5

women or children shall be held without bail until such time it is determined that such person is

1-6

entitled to bail by a justice of the court of jurisdiction.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL
