A N A C T

RELATING TO PROPERTY - RESIDENTIAL LANDLORD AND TENANT ACT

It is enacted by the General Assembly as follows:

     SECTION 1. Section 34-18-52 of the General Laws in Chapter 34-18 entitled

"Residential Landlord and Tenant Act" is hereby amended to read as follows:

     34-18-52. Payment of rent during pendency of appeal. -- Whenever an action for the

recovery of real property is pending on appeal in the superior or supreme court, the tenant in the

1-5

action shall pay to the landlord sums of money equal to the rent for the premises, which the sums

1-6

shall be paid at such times and in such amounts as rent would be due and payable were the action

1-7

not then pending, and shall be due and payable from the date of hearing or entry of judgment,

1-8

whichever is earlier. The acceptance of these sums shall not constitute a waiver of the right of the

1-9

landlord to obtain possession of the premises, nor shall their receipt be deemed to reinstate the

1-10

tenancy.

     SECTION 2. This act shall take effect upon passage.

     This act would require that a tenant, during the pendency of an appeal, pay rent due and

payable from the date of the hearing or entry of judgment, whichever is earlier.

     This act would take effect upon passage.
