It is enacted by the General Assembly as follows: | |

     SECTION 1. Chapter 42-12.3 of the General Laws entitled "Health Care for Children and |

Pregnant Women" is hereby amended by adding thereto the following section: |

     42-12.3-17. Family planning services. – (a) There is hereby established a category of |
1-4 |
medical assistance eligibility pursuant to section 1902(a)(10)(A)(ii)(XXI) of the social security |
1-5 |
act to provide family planning services for individuals whose income is no greater than two- |
1-6 |
hundred fifty percent (250%) of the federal poverty level. |
1-7 |
     (b) The executive office of health and human services is directed to amend the title XIX |
1-8 |
state plan and to submit to the United States department of health and human services an |
1-9 |
amendment to the global consumer choice waiver project to provide for family planning services |
1-10 |
for individuals whose income is no greater than two-hundred fifty percent (250%) of the federal |
1-11 |
poverty level. |
1-12 |
     SECTION 2. This act shall take effect upon passage. |
