It is enacted by the General Assembly as follows: | |

     SECTION 1. Chapter 45-65 of the General Laws entitled "Retirement Security Act for |

Locally Administered Pension Funds" is hereby amended by adding thereto the following section: |

     45-65-10. Binding arbitration prohibited. – No binding arbitration shall be employed |
1-4 |
in the development of any said pension plan. In developing a plan pursuant to this chapter, no |
1-5 |
provision or provisions in any collective bargaining agreement providing for binding arbitration |
1-6 |
shall be applicable or applied to the process. The development of a funding plan shall be deemed |
1-7 |
to take precedence over any provisions providing for binding arbitration between the municipality |
1-8 |
and any class or set of the municipality’s active, inactive, and retired employees. |
1-9 |
     SECTION 2. This act shall take effect upon passage. |
