A N A C T

RELATING TO HEALTH AND SAFETY - PLAN REVIEW FEES

It is enacted by the General Assembly as follows:

     SECTION 1. Section 23-28.2-26 of the General Laws in Chapter 23-28.2 entitled

"Division of Fire Safety" is hereby amended to read as follows:

     23-28.2-26. Plan review fees. -- (a) Every request for plan review, by the state fire

marshal's office, under the provisions of the Fire Safety Code shall be accompanied by the fee

prescribed in this section. Plan review fees shall be as follows:

     NEW BUILDING, ADDITIONS, ALTERATION, STRUCTURES, ETC. General permit

fees based on cost of construction

     $500 or less ............ $25.00

1-9

     Over $500 but not over $1,000 ............ $35.00

1-10

     Over $1,000 but not over $2,000 ............ $45.00

     Over $2,000 but not over $500,000 ............ $45.00+

     (plus $6.00 per $1,000 or fraction thereof over $2,000)

     Over $500,000 ............ $3,033.00+

     (plus $4.00 per $1,000 or fraction thereof over $500,000)

     (b) All fees collected pursuant to this section shall be deposited as general revenue

follows.:

     (1) Fifteen percent (15%) of all plan review fees collected by the division of state fire

1-18

marshal be deposited in a restricted account managed by the division.

     (2) These funds shall be used by the division of the state fire marshal for the following

1-20

purposes:

     (i) To retain the services of licensed professional architects, engineers or consultants to

assist in the plan review process, if necessary as determined by the state fire marshal consistent

2-3

with the terms of subdivision 23-28.1-6(2).

     (ii) To support the training and education requirements of the division of state marshal as

2-5

deemed by the marshal in order to obtain and retain the requisite skills for staff members required

2-6

to perform the duties and services mandated by section 23-28.1-6.

     (3) All remaining fund shall be deposited as general revenue.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would provide that a portion of the fees generated by plan review applications

under the fire code be used to fund the cost of professional services and training education.

     This act would take effect upon passage.
