A N A C T

RELATING TO HIGHWAYS - CONSTRUCTION AND MAINTENANCE OF STATE

ROADS

It is enacted by the General Assembly as follows:

     SECTION 1. Section 24-8-28 of the General Laws in Chapter 24-8 entitled "Construction

and Maintenance of State Roads" is hereby amended to read as follows:

     24-8-28. Sakonnet River stone bridge. -- The department of transportation shall have

full charge and control of the operation and maintenance of the Rhode Island stone bridge across

1-5

Sakonnet River connecting the island of Rhode Island with the mainland, and the bridge is hereby

made a part of the state highway system. The department shall appoint the attendants and other

1-7

employees as may be required for the care and operation of the bridge, and in all matters of the

1-8

care, operation, and maintenance of the bridge the department shall exercise full authority. All

1-9

appropriations for the care, maintenance, and repair of the bridge shall be expended under the

1-10

direction of the department. ; and provided however, that any repairs and/or replacement of the

1-11

bridge across the Sakonnet River shall not result in or otherwise cause any toll charge or fee; and

1-12

provided, further, that no transfer of the bridge to the Rhode Island Bridge and Turnpike

1-13

Authority shall occur without approval by the general assembly.

     SECTION 2. This act shall take effect upon passage.

     This act would prevent a toll being charged for the replacement of the Sakonnet River

bridge and would prohibit transfer of the bridge to the Rhode Island bridge and turnpike authority

without general assembly approval.

     This act would take effect upon passage.
