CREATING A SPECIAL LEGISLATIVE COMMISSION TO STUDY EVICTION | |
PROTECTION FOR TENANTS AND HOMEOWNERS POST FORECLOSURE | |

     RESOLVED, That a special legislative commission be and the same is hereby created |

consisting of eleven (11) members: three (3) of whom shall be members of the Senate, not more |

than two (2) of whom shall be from the same political party, to be appointed by the President of |
1-4 |
the Senate; one of whom shall be the Executive Director of Rhode Island Housing, or designee; |
1-5 |
one of whom shall be the President of the Rhode Island Bankers Association, or designee; one of |
1-6 |
whom shall be the Chair of the Board of the Credit Union Association of Rhode Island, or |
1-7 |
designee; one of whom shall be the Chairperson of Direct Action for Rights & Equality (DARE), |
1-8 |
or designee; one of whom shall be the Executive Director of the Urban League of Rhode Island, |
1-9 |
or designee; one of whom shall be the Executive Minister of the Rhode Island State Council of |
1-10 |
Churches, or designee; one of whom shall be the Housing Resources Coordinator for the Rhode |
1-11 |
Island Housing Resources Commission, or designee, and one of whom shall be the Executive |
1-12 |
Director of Rhode Island Legal Services, or designee. |

     In lieu of any appointment of a member of the legislature to a permanent advisory |
1-14 |
commission, a legislative study commission, or any commission created by a General Assembly |
1-15 |
resolution, the appointing authority may appoint a member of the general public to serve in lieu |
1-16 |
of a legislator, provided that the majority leader or the minority leader of the political party which |
1-17 |
is entitled to the appointment consents to the appointment of the member of the general public. |
1-18 |
     The purpose of said commission shall be to make a comprehensive study of eviction |
1-19 |
protection for tenants and homeowners post foreclosure. The commission shall review laws, |
1-20 |
including, but not limited to, Rhode Island and the Commonwealth of Massachusetts. |
2-1 |
     Forthwith upon passage of this resolution, the members of the commission shall meet at |
2-2 |
the call of the President of the Senate and organize. The President of the Senate shall select a |
2-3 |
chairperson of the commission. |
2-4 |
     Vacancies in said commission shall be filled in like manner as the original appointment. |
2-5 |
     The membership of said commission shall receive no compensation for their services. |
2-6 |
     All departments and agencies of the state shall furnish such advice and information, |
2-7 |
documentary and otherwise, to said commission and its agents as is deemed necessary or |
2-8 |
desirable by the commission to facilitate the purposes of this resolution. |
2-9 |
     The Joint Committee on Legislative Services is hereby authorized and directed to provide |
2-10 |
suitable quarters in the state house for said commission; and be it further |
2-11 |
     RESOLVED, That the commission shall report its findings and results to the Senate on or |
2-12 |
before March 7, 2013, and said commission shall expire on June 6, 2013. |
