It is enacted by the General Assembly as follows: | |

     SECTION 1. Section 28-26-7 of the General Laws in Chapter 28-26 entitled "Hoisting |

Engineers" is hereby amended to read as follows: |

     28-26-7. Application for license -- Examination. -- (a) Each person who desires to act |
1-4 |
as a steam, internal combustion engines, electric, or compressed air hoisting engineer shall make |
1-5 |
application to the division for a license upon a form furnished to him or her, submit a notarized |
1-6 |
list of work experience, have possessed for at least three (3) years prior to the filing of the |
1-7 |
application, a certificate of registration in full force and effect from the department of labor and |
1-8 |
training specifying that person as a registered apprentice hoisting engineer and the application of |
1-9 |
that applicant is accompanied with an affidavit or affidavits of his or her employer or former |
1-10 |
employers or other reasonably satisfactory evidence showing that the applicant has been actually |
1-11 |
engaged in hoisting work as an apprentice hoisting engineer in the state of Rhode Island for six |
1-12 |
thousand (6,000) hours of on the job training during a three (3) year period, which shall include |
1-13 |
the successful completion of four hundred thirty-two (432) hours of related instruction at a |
1-14 |
training program recognized by the department of labor and training, and shall pass an |
1-15 |
examination on the construction and operation of steam, electric, internal combustion engines, |
1-16 |
and compressed air engines and machinery. Applications for examinations must be received |
1-17 |
fifteen (15) working days prior to the examination date. |

      (b) Any person applying for a license and who knowingly makes any misstatement as to |
1-19 |
his or her work experience or other qualifications shall be subject to the penalties provided for in |
1-20 |
section 28-26-11. |

      (c) In addition to the requirements for submitting an application for examination, as |
2-2 |
required in subsection (a) above, any person applying for a full license, a hydraulic crane license, |
2-3 |
or a lattice crane license shall also be required to include a valid medical health card with their |
2-4 |
application. A separate notarized statement shall also be attached to the application, and shall |
2-5 |
contain all work related experience, including all equipment trained on and/or operated. |

      (d) In addition to the requirements for submitting an application for examination, as |
2-7 |
required in subsection (a) above, any person applying for a construction forklift license or a full |
2-8 |
license shall also be required to include a copy of their OSHA forklift certification with their |
2-9 |
application. |
2-10 |
     SECTION 2. This act shall take effect upon passage and shall be implemented six (6) |
2-11 |
months after passage of this act. |
