RELATING TO CRIMINAL OFFENSES - WEAPONS | |

It is enacted by the General Assembly as follows: | |

     SECTION 1. Chapter 11-47 of the General Laws entitled "Weapons" is hereby amended |

by adding thereto the following section: |

     11-47-20.4. Body armor. -- It shall be unlawful within this state for any person to |
1-4 |
purchase, own or possess body armor, if that person has been convicted of a felony that is a crime |
1-5 |
of violence. It shall be an affirmative defense under this section that the defendant obtained prior |
1-6 |
written certification from his or her employer that the defendant’s purchase, use or possession of |
1-7 |
body armor was necessary for the safe performance of lawful business activity. Any person who |
1-8 |
violates the provisions of this section shall be punished by imprisonment for not more than three |
1-9 |
(3) years, or a fine of not more than five thousand dollars ($5,000), or both. |
1-10 |
     SECTION 2. This act shall take effect upon passage. |
