It is enacted by the General Assembly as follows: | |

     SECTION 1. Section 36-4-10 of the General Laws in Chapter 36-4 entitled "Merit |

System" is hereby amended to read as follows: |

     36-4-10. Changes in plan -- Notice of establishment of new positions. -- Additional |
1-4 |
classes may be established and existing classes may be divided, combined, altered, or abolished |
1-5 |
upon recommendation of the personnel administrator, recommendation by the director after |
1-6 |
public hearing, and approval by the governor. This action may be initiated either by the personnel |
1-7 |
administrator, the director, or on request of an appointing authority. Appointing authorities |
1-8 |
intending to establish new positions shall so notify the personnel administrator, and except as |
1-9 |
otherwise provided in this chapter, no person shall be appointed to or employed for a new |
1-10 |
position until it has been properly classified as herein provided and an appropriate list established |
1-11 |
therefor. The director shall hold a public hearing no later than November 30, 2012, and at least bi- |
1-12 |
annually thereafter. |
1-13 |
     SECTION 2. This act shall take effect upon passage. |
