A N A C T

RELATING TO ALCOHOLIC BEVERAGES -- REGULATION OF SALES

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 3-8 of the General Laws entitled "Regulation of Sales" is hereby

amended by adding thereto the following section:

     3-8-17. Purchase and consumption of alcoholic beverages by minors in the military.

-- (a) Notwithstanding any provision of the general or public laws to the contrary, any individual

1-5

eighteen (18) years of age, but younger than twenty-one (21) years of age who presents a valid

1-6

and current military identification evidencing that the person is serving in a branch of the

1-7

uniformed military services of the United States may:

1-8

     (1) Enter onto and remain on any premises licensed to sell beverages as defined in this

1-9

title;

1-10

     (2) Purchase or have beverages as defined in this title served or delivered to him or her at

1-11

the licensed premises;

1-12

     (3) Receive beverages as defined in this title at the licensed premises for consumption to

1-13

the extent permitted by the premises license; and

1-14

     (4) Possess beverages as defined in this title on the licensed premises for his or her own

1-15

use to the extent possession is not inconsistent with the premises license.

     (b) Any person who aids or assists an individual eighteen (18) years of age or older but

1-17

younger than twenty-one (21) years of age who is currently serving in a branch of the uniformed

1-18

military services of the United States in purchasing, obtaining, or possessing beverages as defined

1-19

in this title shall not be in violation of any provision of this chapter.

     SECTION 2. Section 3-8-6.2 of the General Laws in Chapter 3-8 entitled "Regulation of

Sales" is hereby amended to read as follows:

     3-8-6.2. Unlawful use of identification cards. -- (a) It is be unlawful for any person:

      (1) To display or cause or permit to be displayed or have in his or her possession any

2-24

cancelled, revoked, suspended, fictitious, or fraudulently altered official Rhode Island or United

2-25

States Military identification card;

2-26

      (2) To lend his or her Rhode Island or United States Military identification card to any

2-27

other person or knowingly permit the use of the card by another person;

2-28

      (3) To display or represent as one's own the Rhode Island or United States Military

2-29

identification card of another;

2-30

      (4) To fail or refuse to surrender to the division of motor vehicles upon lawful demand

2-31

any Rhode Island or United States Military identification card which has been suspended,

2-32

revoked, or cancelled;

2-33

      (5) To use a false or fictitious name in any application for a Rhode Island or United

2-34

States Military identification card or to knowingly make a false statement or to knowingly

2-35

conceal a material fact or otherwise commit a fraud in any such application;

      (6) To knowingly permit any unlawful use of his or her Rhode Island or United States

2-37

Military identification card; and

2-38

      (7) To aid or assist another to fraudulently obtain a Rhode Island or United States

2-39

Military identification card.

      (b) Any violation of subdivisions (a)(1) through (a)(7) of this section is punishable as a

2-41

misdemeanor.

     SECTION 3. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would permit any person over eighteen (18) years of age and under twenty-one

(21) years of age who is currently serving in the uniformed services of the United States military

3-3

to consume alcoholic beverages.

3-4

     This act would take effect upon passage.
