RELATING TO LABOR AND LABOR RELATIONS -- WORKERS' COMPENSATION --

GENERAL PROVISIONS

     Introduced By: Senators Lombardi, Doyle, Goodwin, McCaffrey, and Ciccone

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 28-29 of the General Laws entitled "Workers' Compensation -

General Provisions" is hereby amended by adding thereto the following section:

     28-29-31. Bidders' required statement. – (a) All contractors and subcontractors shall

agree as a pre-condition for bidding on public works contracts for any prevailing wage work for

state or municipal public works contracts to comply with the prevailing conditions:

     (1) Prior to any work being performed by an individual contractor on any state, or

1-7

municipal public works project, contractors and subcontractors must provide certification that

1-8

their workers are covered by current workers' compensation coverage. Said certification shall be

1-9

submitted on a form to be provided by the department of labor and training. The exception set

1-10

forth in subdivision 28-29-2(4) shall not apply to public construction work as designated herein.

     (2) Nothing in this section shall be construed to limit the provisions of chapter 37-14.1.

     SECTION 2. This act shall take effect upon passage.
