RELATING TO HEALTH AND SAFETY -- LICENSING OF HEALTHCARE FACILITIES | |

It is enacted by the General Assembly as follows: | |

     SECTION 1. Chapter 23-17 of the General Laws entitled "Licensing of Health Care |

Facilities" is hereby amended by adding thereto the following section: |

     23-17-49.1. Required use of a brain monitor or pulse oximeter with general |
1-4 |
anesthesia. – Notwithstanding any provision of law to the contrary contained in any general or |
1-5 |
public law, rule or regulation, during any medical procedure where a patient will be rendered |
1-6 |
unconscious as a result of the use of general anesthesia, a brain monitor or a pulse oximeter, |
1-7 |
whereby the oxygenation of a patient is monitored, must also be used. |
1-8 |
     SECTION 2. Chapter 27-18 of the General Laws entitled "Accident and Sickness |
1-9 |
Insurance Policies" is hereby amended by adding thereto the following section: |

     27-18-79. Coverage for use of a brain monitor or pulse oximeter with general |
1-11 |
anesthesia. – All expenses associated with the use of a brain monitor or a pulse oximeter are |
1-12 |
eligible for reimbursement, where the use of general anesthesia is eligible for reimbursement, |
1-13 |
under the provisions of any individual or group health insurance contract, plan or policy entered |
1-14 |
into or renewed in this state on or after January 1, 2014. |

     SECTION 3. Chapter 27-19 of the General Laws entitled "Nonprofit Hospital Service |
1-16 |
Corporations" is hereby amended by adding thereto the following section: |

     27-19-70. Coverage for use of a brain monitor or pulse oximeter with general |
1-18 |
anesthesia. – All expenses associated with the use of a brain monitor or a pulse oximeter are |
1-19 |
eligible for reimbursement, where the use of general anesthesia is eligible for reimbursement, |
1-20 |
under the provisions of any individual or group health insurance contract, plan or policy entered |

into or renewed in this state on or after January 1, 2014. |

     SECTION 4. Chapter 27-20 of the General Laws entitled "Nonprofit Medical Service |

Corporations" is hereby amended by adding thereto the following section: |

     27-20-66. Coverage for use of a brain monitor or pulse oximeter with general |
2-5 |
anesthesia. – All expenses associated with the use of a brain monitor or a pulse oximeter are |
2-6 |
eligible for reimbursement, where the use of general anesthesia is eligible for reimbursement, |
2-7 |
under the provisions of any individual or group health insurance contract, plan or policy entered |
2-8 |
into or renewed in this state on or after January 1, 2014. |

     SECTION 5. Chapter 27-20.1 of the General Laws entitled "Nonprofit Dental Service |

Corporations" is hereby amended by adding thereto the following section: |

     27-20.1-21. Coverage for use of a brain monitor or pulse oximeter with general |
2-12 |
anesthesia. – All expenses associated with the use of a brain monitor or a pulse oximeter are |
2-13 |
eligible for reimbursement, where the use of general anesthesia is eligible for reimbursement, |
2-14 |
under the provisions of any individual or group health insurance contract, plan or policy entered |
2-15 |
into or renewed in this state on or after January 1, 2014. |
2-16 |
     SECTION 6. Chapter 27-41 of the General Laws entitled "Health Maintenance |
2-17 |
Organizations" is hereby amended by adding thereto the following section: |
2-18 |
     27-41-83. Coverage for use of a brain monitor or pulse oximeter with general |
2-19 |
anesthesia. – All expenses associated with the use of a brain monitor or a pulse oximeter are |
2-20 |
eligible for reimbursement, where the use of general anesthesia is eligible for reimbursement, |
2-21 |
under the provisions of any individual or group health insurance contract, plan or policy entered |
2-22 |
into or renewed in this state on or after January 1, 2014. |
2-23 |
     SECTION 7. This act shall take effect upon passage. |
