RELATING TO ALCOHOLIC BEVERAGES | |

It is enacted by the General Assembly as follows: | |

     SECTION 1. Section 3-6-1.2 of the General Laws in Chapter 3-6 entitled "Manufacturing |

and Wholesale Licenses" is hereby amended to read as follows: |

     3-6-1.2. |

manufacturer's license. -- (a) A brewpub and microbrewery manufacturer's license shall |
1-5 |
authorize the holder to establish and operate a brewpub or microbrewery within this state. The |
1-6 |
brewpub and microbrewery manufacturer's license shall authorize the retail sale of the beverages |
1-7 |
manufactured on the location for consumption on the premises. The license shall not authorize the |
1-8 |
retail sale of beverages from any location other than the location set forth in the license. A |
1-9 |
brewpub or microbrewery may sell at retail alcoholic beverages produced on the premises by the |
1-10 |
half-gallon bottle known as a "growler" to consumers for off the premises consumption to be sold |
1-11 |
pursuant to the laws governing retail Class A establishments. |
1-12 |
      (b) The license shall also authorize the sale at wholesale at the licensed place by the |
1-13 |
manufacturer of the product of his or her licensed plant as well as beverages produced for the |
1-14 |
brewpub or microbrewery and sold under the brewpub's or microbrewery's name to a holder of a |
1-15 |
wholesaler's license and the transportation and delivery from the place of sale to the licensed |
1-16 |
wholesaler or to a common carrier for that delivery. |

      (c) The brewpub and microbrewery manufacturer's license further authorizes the sale of |
1-18 |
beverages manufactured on the premises to any person holding a valid wholesaler's and importer's |
1-19 |
license under section 3-6-9 or 3-6-11. |

      (d) The annual fee for the license is one thousand dollars ($1,000) for a brewpub or |
2-21 |
microbrewery producing more than fifty thousand (50,000) gallons per year and five hundred |
2-22 |
dollars ($500) per year for a brewpub or microbrewery producing less than fifty thousand |
2-23 |
(50,000) gallons per year. The annual fee is prorated to the year ending December 1 in every |
2-24 |
calendar year and paid to the division of taxation and turned over to the general treasurer for the |
2-25 |
use of the state. |

     SECTION 2. Section 3-7-7.2 of the General Laws in Chapter 3-7 entitled "Retail |
2-27 |
Licenses" is hereby amended to read as follows: |

microbrewery license -- Class B-M. -- (a) A manufacturer's brewpub and microbrewery Class |
2-30 |
B-M license shall be issued only to a holder of a manufacturer's license as described in section 3- |
2-31 |
6-1. The license shall not authorize the retail sale of beverages from any location other than at the |
2-32 |
location stated in the manufacturer's license for the manufacture of beverages. |

      (b) The license shall not authorize the retail sale of beverages from any location other |
2-34 |
than as provided in section 3-6-1.2. |

      (c) The holder of a license issued pursuant to the provisions of this section shall not be |
2-36 |
otherwise barred from application for a Class B license, where permitted by local licensing |
2-37 |
authorities. |
2-38 |
     SECTION 3. This act shall take effect upon passage. |
