RELATING TO STATE AFFAIRS AND GOVERNMENT - OFFICE OF HEALTH AND

HUMAN SERVICES

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 42-7.2 of the General Laws entitled "Office of Health and Human

Services" is hereby amended by adding thereto the following section:

     42-7.2-18. Family planning program. – (a) The executive office of health and human

1-4

services is authorized and directed to apply for and obtain, or amend, an appropriate waiver from

1-5

the secretary of the U.S. department of health and human services to require that individuals (who

1-6

lack health insurance coverage of family planning services and supplies or have high-deductible

1-7

coverage and) whose income is no greater than two-hundred fifty percent (250%) of the federal

1-8

poverty level receive family planning services and supplies described in 42 U.S.C. section

1-9

1396d(a)(4)(C).

     (b) Reimbursement for family planning services and supplies shall be set at the rate

1-11

provided through Medicaid managed care.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would require that there be a waiver from the secretary of the department of

health and human services so that people who do not have healthcare, high deductible coverage,

2-3

or income less than two hundred fifty percent (250%) of the federal poverty level receive family

2-4

planning services and supplies. Also, the rate for reimbursement would be set at the Medicaid

2-5

managed care rate.

     This act would take effect upon passage.
