It is enacted by the General Assembly as follows: | |

     SECTION 1. Chapter 28-9 of the General Laws entitled "Arbitration of Labor |

Controversies" is hereby amended by adding thereto the following section: |

     28-9-1.1. Certain rights of retired police and firefighters. – Any police officer or |
1-4 |
firefighter who retired under the terms, conditions, or benefits set forth in a collective bargaining |
1-5 |
agreement providing for said benefits at the time of his or her retirement, may seek enforcement |
1-6 |
of those rights and benefits under the provisions of this chapter unless expressly prohibited by the |
1-7 |
grievance/arbitration provisions of the applicable collective bargaining agreement. The rights or |
1-8 |
benefits claimed by said retiree must arise out of the express terms of the collective bargaining |
1-9 |
agreement, and the labor organization charged with administration of the current collective |
1-10 |
bargaining agreement must have expressly authorized arbitration of the dispute or controversy in |
1-11 |
accordance with the provisions of this chapter. |
1-12 |
     SECTION 2. This act shall take effect upon passage. |
