RELATING TO CRIMINAL OFFENSES - FIREARM VIOLATIONS | |

It is enacted by the General Assembly as follows: | |

     SECTION 1. Section 11-47-3.1 of the General Laws in Chapter 11-47 entitled |

"Weapons" is hereby amended to read as follows: |
1-3 |
     11-47-3.1. Carrying a stolen firearm when committing a crime of violence. -- No |
1-4 |
person shall commit a crime of violence when armed with or having available a stolen firearm. |
1-5 |
Every person violating the provisions of this section shall be punished: (1) for the first conviction |
1-6 |
by imprisonment for not less than five (5) nor more than |
1-7 |
second conviction under this section by imprisonment for not less than fifteen (15) nor more than |
1-8 |
twenty (20) years; and (3) for a third or subsequent conviction under this section by imprisonment |
1-9 |
for not less than twenty (20) years and may be imprisoned for life. The sentence imposed shall be |
1-10 |
consecutive to the underlying sentence for the crime of violence. |
1-11 |
     SECTION 2. Chapter 11-47 of the General Laws entitled "Weapons" is hereby amended |
1-12 |
by adding thereto the following section: |
1-13 |
     11-47-5.2. Possession of a stolen firearm. -- It shall be unlawful for any person to |
1-14 |
possess a firearm, knowing it to be stolen. Any person in violation of this section shall be guilty |
1-15 |
of a felony and subject to imprisonment for not less than three (3) years nor more than fifteen (15) |
1-16 |
years. |

     SECTION 3. Section 11-47-23 of the General Laws in Chapter 11-47 entitled "Weapons" |
1-18 |
is hereby amended to read as follows: |
1-19 |
     11-47-23. False information in securing firearm or license. – No person shall, in |
1-20 |
purchasing or otherwise securing delivery of a shotgun, rifle, pistol, or revolver, or in applying |
2-1 |
for a license to carry it, give false information or offer false evidence of his or her identity. |
2-2 |
Violation of the provisions of this section may be punishable by a fine of not more than five |
2-3 |
thousand dollars ($5,000), imprisonment for not more than five (5) years, or both. |
2-4 |
     SECTION 4. This act shall take effect upon passage. |
