RELATING TO ALCOHOLIC BEVERAGES - RETAIL LICENSES

     

     Introduced By: Representatives Ucci, Shekarchi, Hull, DeSimone, and Carnevale

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 3-7-5 of the General Laws in Chapter 3-7 entitled "Retail Licenses"

is hereby amended to read as follows:

     3-7-5. Class A license issued to Class E licensee. -- It is permissible for the holder of a

4

retailer's Class E license to hold a retailer's Class A license. No Class A license shall be granted to

5

a holder of a Class E license unless the holder of a Class E license maintains, operates, manages,

6

or conducts a drugstore. The drugstore shall be operated as a self-contained and independent

7

establishment and shall not be located in, or be operated as, a part of any market, department

8

store, or hardware store. For a Class A license as described, the holder of a Class E license shall

9

pay the regular annual license fee and have the full privilege of a Class A license. Provided,

10

however, the licensing authority for the city of Providence may relieve the holder of a Class E

11

license from the requirement to maintain, operate, manage, or conduct a drugstore as a condition

12

of the continued holding of a Class A license issued to or renewed by said licensee.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO ALCOHOLIC BEVERAGES - RETAIL LICENSES

     This act would grant the licensing authority of the city of Providence the discretion to

2

relieve holders of Class E licenses from the requirement of maintaining, operating, managing or

3

conducting a drug store as a condition of the continued holding of a Class A license.

4

     This act would take effect upon passage.
