H O U S E   R E S O L U T I O N

CREATING A SPECIAL LEGISLATIVE COMMISSION TO STUDY THE CATEGORIES,

METHODS, AND MONETARY IMPLICATIONS OF TAXING VARIOUS PERSONAL

RETIREMENT INCOME AND PENSION INCOME PAID TO RHODE ISLANDERS BY

OUT-OF-STATE EMPLOYERS

     RESOLVED, That a special legislative commission be and the same is hereby created

2

consisting of seven (7) members: two (2) of whom shall be members of the Rhode Island House

3

of Representatives, not more than one from the same political party, to be appointed by the

4

Speaker of the House; one of whom shall be the Chair of the House Finance Committee, or

5

designee; one of whom shall be the Director of the Rhode Island Department of Revenue, or

6

designee; one of whom shall be the Auditor General, or designee; one of whom shall be the

7

Director of the Department of Administration, or designee; and one of whom shall be the Rhode

8

Island General Treasurer, or designee.

     In lieu of any appointment of a member of the legislature to a permanent advisory

10

commission, a legislative study commission, or any commission created by a General Assembly

11

resolution, the appointing authority may appoint a member of the general public to serve in lieu

12

of a legislator, provided that the Majority Leader or the Minority Leader of the political party

13

which is entitled to the appointment consents to the appointment of the member of the general

14

public.

     The purpose of said commission shall be to make a comprehensive study and analysis of

16

the laws of Rhode Island and nearby states, and procedures for taxing various personal retirement

17

income and pension income paid by out-of-state employers, including, but not limited to the fiscal

18

impact of various exemptions and tax policy on social security income, federal, state, military,

and civil service pensions, in order to determine whether to amend, alter, or repeal any applicable

2

law, policies, or regulations to better serve the best interest of the citizens of the State of Rhode

3

Island.

     Forthwith upon passage of this resolution, the members of the commission shall meet at

5

the call of the Speaker of the House and organize and shall select from among the legislators a

6

chairperson. Vacancies in said commission shall be filled in like manner as the original

7

appointment.

     The membership of said commission shall receive no compensation for their services.

9

     All departments and agencies of the state shall furnish such advice and information,

10

documentary and otherwise, to said commission and its agents as is deemed necessary or

11

desirable by the commission to facilitate the purposes of this resolution.

     The Speaker of the House is hereby authorized and directed to provide suitable quarters

13

for said commission; and be it further

14

     RESOLVED, That the commission shall report its findings and recommendations to the

15

House of Representatives on or before June 3, 2014, and said commission shall expire on

16

September 3, 2014.

     This resolution would create a seven (7) member special legislative study commission

2

whose purpose it would be to study the laws of Rhode Island and nearby states, and procedures

3

for taxing various personal retirement income and pension income paid by out-of-state

4

employers, and who would report back to the House of Representatives no later than June 3,

5

2014, and whose life would expire on September 3, 2014.
