A N   A C T

RELATING TO MOTOR AND OTHER VEHICLES -- ELECTRONIC CITATIONS

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 31-27 of the General Laws entitled "Motor Vehicle Offenses" is

hereby amended by adding thereto the following section:

     31-27-12.5. Electronic citation system for traffic offenses . – (a) The administrative

clerk of the judicial department shall, upon approval of the content and form of the summonses

and related records in electronic form by the chief magistrate of the traffic tribunal and by the

supreme court, provide for electronic transmittal of those forms required by section 31-27-12.2 by

electronic means to the appropriate judicial venue.

     (b) To defray the cost of establishing and maintaining the electronic citation system the

court receiving the citation shall charge an additional electronic citation fee of five dollars ($5.00)

in every case not disposed of by a finding of not guilty, or dismissed.

     (c) Sixty percent (60%) of the fee shall be retained by the court, and forty percent (40%)

shall be disbursed to the arresting agency to defray expenses related to the establishment and

operation of the electronic citation system.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would establish a system for the electronic generation and transmittal of those

documents generated by a police agency as a consequence of a traffic citation.

     This act would take effect upon passage.
