A N   A C T

RELATING TO HIGHWAYS - CONSTRUCTION AND MAINTENANCE OF STATE

ROADS

     Introduced By: Representatives Giarrusso, Chippendale, Newberry, Trillo, and Costa

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 24-8 of the General Laws entitled "Construction and Maintenance

of State Roads" is hereby amended by adding thereto the following section:

     24-8-45. State, City and Town Road and Bridge Maintenance Account. – (a) All fees

assessed pursuant to title 31, chapters 3, 6, 10, 10.1, 10.3, 38, 34, 47.1 and 47.2 shall be deposited

into a restricted receipt account, hereby created and known as the state, city and town road and

bridge maintenance account. The account is also authorized to receive fund transfers and

appropriations from the general fund. Funds from the account may only be used to cover the costs

of maintenance relating to state and local highway and bridge proposals.

     (b) Priority for use of the funds from the account shall be for:

     (1) The maintenance of state and local bridges not including the construction or

replacement of the same; and

     (2) The maintenance of existing state and local roads and highways.

     (c) The department of transportation is hereby authorized to promulgate rules and

regulations, including, but not limited to, the development of separate priority lists ranking the

maintenance needs of the various state and local bridges, roads and highways, and the

disbursement of fees collected pursuant to subsection (a). These lists shall be sent to all cities and

towns throughout the state. Additionally, the department shall keep all cities and towns apprised

of the balance of the funds in said maintenance account and the funds available for disbursement.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would create a restricted receipt account for the maintenance of all state and

local bridges, roads and highways funded by any and all motor vehicle licensing fees and

surcharges set forth in title 31 to be administered by the department of transportation.

     This act would take effect upon passage.
