RELATING TO HIGHWAYS - OUTDOOR ADVERTISING | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 24-10.1-3 of the General Laws in Chapter 24-10.1 entitled |
2 | "Outdoor Advertising" is hereby amended to read as follows: |
3 | 24-10.1-3. Limitations of outdoor advertising devices. -- No outdoor advertising shall |
4 | be erected in this state except the following: |
5 | (1) Directional and other official signs and notices erected, maintained, or authorized by |
6 | a public agency or body, which signs and notices shall include, but not be limited to, signs and |
7 | notices pertaining to natural wonders and scenic and historic attractions, as authorized or required |
8 | by law. |
9 | (2) Signs, displays, and devices advertising the sale or lease of property upon which they |
10 | are located, subject, however, to the national standards as promulgated pursuant to the federal |
11 | Highway Beautification Act of 1965. |
12 | (3) Signs, displays, and devices advertising activities conducted on the property upon |
13 | which they are located, subject, however, to the national standards as promulgated pursuant to the |
14 | federal Highway Beautification Act of 1965 including spacing requirements of the Rhode Island |
15 | department of transportation rules and regulations governing outdoor advertising, except for signs |
16 | that are allowed to be relocated as permitted in subsection (5). |
17 | (4) Bus shelters erected under the authority of the state department of transportation or |
18 | Rhode Island public transit authority which shall be permitted no more than one two (2) sided |
19 | sign. Each sign face shall be no more than twenty-four (24) square feet in size. |

1 | (5) Lawfully permitted signs, displays, and devices already in existence may be relocated |
2 | to other permitted locations with the approval of the appropriate state and municipal |
3 | governmental agency(s), provided that the relocated outdoor advertising remains the same or |
4 | smaller in size, and that such outdoor advertising conforms and is consistent with the municipal |
5 | comprehensive plan and related zoning requirements. |
6 | (6) This chapter shall not preclude the maintenance of existing outdoor advertising. |
7 | SECTION 2. This act shall take effect upon passage. |
