It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 39-18 of the General Laws entitled "Rhode Island Public Transit |
2 | Authority" is hereby amended by adding thereto the following sections: |
3 | 39-18-25. Limitations of damages. – In any tort action against the authority, its |
4 | members and/or its employees acting in their official capacity, any damages recovered therein |
5 | shall not exceed the sum of one hundred thousand dollars ($100,000). |
6 | 39-18-26. Damages in excess of limitation. – The general assembly may, by special act, |
7 | authorize actions of tort against the authority, its members and/or its employees acting in their |
8 | official capacity, in particular cases in which the amount of damages to be recovered may exceed |
9 | one hundred thousand dollars ($100,000). |
10 | SECTION 2. This act shall take effect upon passage and shall apply to actions filed on or |
11 | after the date of passage of this act. |

5 | of passage of this act. |
