RELATING TO HEALTH AND SAFETY - STATE BUILDING CODE

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 23-27.3-108.1.1 of the General Laws in Chapter 23-27.3 entitled

"State Building Code" is hereby amended to read as follows:

     23-27.3-108.1.1. Applications and permits. – (a) The building official shall issue all

4

necessary notices or orders to remove illegal or unsafe conditions, to require the necessary

5

safeguards during construction, to require adequate exitway facilities in new and existing

6

buildings and structures, and to insure compliance with all the code requirements for the safety,

7

health, and general welfare of the public. The state building commissioner shall assume the

8

authority for the purpose of enforcing the provisions of this code when not otherwise provided

9

for.

     (b) The building official shall examine or cause to be examined all applications for

11

permits and amendments thereto within thirty (30) days after filing thereof. If the application or

12

the construction documents do not conform to the requirements and all pertinent laws under the

13

building official's jurisdiction, the building official shall reject such application in writing, stating

14

the reasons therefor. If the building official is satisfied that the proposed work conforms to the

15

code requirements and all laws and ordinances applicable thereto, the building official shall issue

16

a permit therefor.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO HEALTH AND SAFETY - STATE BUILDING CODE

     This act would require the local building official to examine all applications for permits

2

or amendments thereto within thirty (30) days of filing and either issue the permit or reject it in

3

writing stating the reasons for rejection.

4

     This act would take effect upon passage.
