RELATING TO CRIMINAL PROCEDURE - CAPITOL POLICE OFFICERS' POWERS

It is enacted by the General Assembly as follows:

     SECTION 1. Section 12-2.2-2 of the General Laws in Chapter 12-2.2 entitled "Capitol

2

Police for Public Buildings" is hereby amended to read as follows:

     12-2.2-2. Powers of capitol police officers. -- Upon issuance of a license under section

4

ยง12-2.2-1, the person so designated as a capitol police officer shall have the same immunities and

5

may exercise, in and upon the lands and buildings owned or leased by the state of Rhode Island

6

and assigned to the Rhode Island public buildings authority, or to any municipal or private facility

7

in which a state agency or a state court is convening a public meeting or public hearing, and upon

8

streets and highways immediately adjacent to those lands, the same powers and authority of a

9

police officer, as are conferred by the laws of this state upon members of the division of state

10

police, including the power to arrest persons for violation of state criminal statutes or for violation

11

of city or town ordinances of the city or town in which the state property is located.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO CRIMINAL PROCEDURE - CAPITOL POLICE OFFICERS' POWERS

     This act would enable capitol police officers assigned to buildings leased by the state as

2

well as officers assigned to any municipal or private facility where a state agency or state court is

3

convening a public meeting or hearing the authority and powers already assigned while acting in

4

their official capacity in a state owned public building or state owned land.

5

     This act would take effect upon passage.
