RELATING TO COURTS AND CIVIL PROCEDURE - PROCEDURE GENERALLY - FEES

     It is enacted by the General Assembly as follows:

     SECTION 1. Sections 9-29-14 and 9-29-19 of the General Laws in Chapter 9-29 entitled

"Fees" are hereby amended to read as follows:

     9-29-14. Legal Aid Society and Rhode Island Legal Services, Inc. exempt from fees

4

Legal Aid Society and Rhode Island Legal Services, Inc. and Rhode Island Center for Law

5

and Public Policy, Inc. exempt from fees. -- Neither the Legal Aid Society of Rhode Island, nor

6

Rhode Island Legal Services, Inc., nor Rhode Island Center for Law and Public Policy, Inc. shall

7

be required to pay any fees to the superior court, family court, or district courts or the clerks

8

thereof or any fees or charges for the service or travel of deputy sheriffs for serving any writ,

9

citation, subpoena or other process or for taking bail, bond, or inventory or for making copies of

10

writs for or in behalf of the organizations or their clients; provided, however, that fees and

11

charges authorized by law shall nevertheless be taxable as costs.

     9-29-19. Family court fees. -- (a) The family court shall be allowed the following fees

13

in full to be taxed in the bill of costs in every domestic relations or other civil proceeding:

14

      (1) For the entry of every petition, complaint, or action ............ $120.00 130.00

15

     (2) For every writ of execution ............ $40.00

16

     (b) In addition to the fees as set forth herein, a surcharge shall be placed on all filing fees.

17

     (c) Provided, that ten dollars ($10.00) of the fee for the entry of every petition, complaint

18

or action shall be forwarded each to Rhode Island legal services and the Rhode Island Center for

19

Law and Public Policy.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

OF

RELATING TO COURTS AND CIVIL PROCEDURE - PROCEDURE GENERALLY - FEES

     This act would increase Family Court filing fees by ten dollars ($10.00), which would be

2

transferred to the RI Center for Law and Public Policy. The center would be exempt from filing

3

fees.

4

     This act would take effect upon passage.
