It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 12-29 of the General Laws entitled "Domestic Violence Prevention |
2 | Act" is hereby amended by adding thereto the following section: |
3 | 12-29-12. Jurisdiction to prosecute - Attorney general. – All alleged violations of this |
4 | chapter shall be prosecuted exclusively by the attorney general pursuant to the provisions of § 42- |
5 | 9-4. |
6 | SECTION 2. Section 42-9-4 of the General Laws in Chapter 42-9 entitled "Department |
7 | of Attorney General" is hereby amended to read as follows: |
8 | 42-9-4. Prosecution of offenses. -- (a) The attorney general shall draw and present all |
9 | informations and indictments, or other legal or equitable process, against any offenders, as by law |
10 | required, and diligently, by a due course of law or equity, prosecute them to final judgment and |
11 | execution. |
12 | (b) The duty of the attorney general under this section shall include the duty to prosecute |
13 | all charges of violations of sections 31-27-2.1, 31-27-2.3, and/or 31-27-2.5, jurisdiction over the |
14 | adjudication of which is conferred upon the traffic tribunal under chapter 41.1 of title 31. |
15 | (c) The duty of the attorney general under this section shall include the duty to prosecute |
16 | all alleged violations of chapter 29 of title 12. |
17 | SECTION 3. This act shall take effect upon passage. |
