It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 23-21.1-8 of the General Laws in Chapter 23-21.1 entitled |
2 | "Sanitation Standards for Bathing Beaches" is hereby amended to read as follows: |
3 | 23-21.1-8. Beach closings/openings. – (a) The department shall order closed, any |
4 | bathing beach where it is established that the following or other conditions pose an imminent |
5 | threat to public health. The bathing beach shall remain closed until the department determines the |
6 | bathing water no longer poses an unacceptable risk to public health or safety. A bathing beach |
7 | may be closed for, but not limited to, the following: |
8 | (1) A violation of minimum water quality standards at a designated bathing beach; |
9 | (2) The presence of sewage sludge deposits or solid refuse; |
10 | (3) Floating solid, grease or scum wastes; or |
11 | (4) Oil or other hazardous material. |
12 | (b) Any beach closed pursuant to this section shall not be permitted to charge for parking |
13 | until such time as the beach can be re-opened. |
14 | SECTION 2. This act shall take effect upon passage. |
