RELATING TO HEALTH AND SAFETY -- SANITATION STANDARDS FOR BATHING

BEACHES

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 23-21.1-8 of the General Laws in Chapter 23-21.1 entitled

"Sanitation Standards for Bathing Beaches" is hereby amended to read as follows:

     23-21.1-8. Beach closings/openings. – (a) The department shall order closed, any

4

bathing beach where it is established that the following or other conditions pose an imminent

5

threat to public health. The bathing beach shall remain closed until the department determines the

6

bathing water no longer poses an unacceptable risk to public health or safety. A bathing beach

7

may be closed for, but not limited to, the following:

8

      (1) A violation of minimum water quality standards at a designated bathing beach;

9

      (2) The presence of sewage sludge deposits or solid refuse;

10

      (3) Floating solid, grease or scum wastes; or

11

      (4) Oil or other hazardous material.

     (b) Any beach closed pursuant to this section shall not be permitted to charge for parking

13

until such time as the beach can be re-opened.

14

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

     This act would prohibit any closed beach under this section from charging parking fees.

2

     This act would take effect upon passage.
