RELATING TO ANIMALS AND ANIMAL HUSBANDRY - CRUELTY TO ANIMALS

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 4-1-7 of the General Laws in Chapter 4-1 entitled "Cruelty to

Animals" is hereby amended to read as follows:

     4-1-7. Live poultry containers. – (a) Any crate or other container used for the purpose

of transporting, shipping, or holding for sale any live poultry shall be in a sanitary condition and

shall be constructed so as to provide sufficient ventilation and warmth and the poultry, while in

that container, shall receive any reasonable care as may be required to prevent unnecessary

suffering. Any person violating any provision of this section shall, for each offense, be

imprisoned not exceeding fifteen (15) days or be fined not exceeding one hundred dollars ($100),

or both.

     (b) Battery cages used for the purpose of egg-laying hens shall be prohibited. Any person

violating this provision shall be guilty of a misdemeanor and imprisoned up to one year or fined

one thousand dollars ($1,000), or both.

     SECTION 2. This act shall take effect upon passage.
