RELATING TO EDUCATION - RIGHTS AND DUTIES OF TEACHERS GENERALLY

     

     Introduced By: Senators Satchell, Lombardi, Metts, Algiere, and Sheehan

     Referred To: Senate Education

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 16-12 of the General Laws entitled "Rights and Duties of Teachers

Generally" is hereby amended by adding thereto the following section:

     16-12-11. Teacher evaluation. – (a) For the purposes of this section, "certified teachers"

4

means certified teaching personnel employed in the public school systems in the state of Rhode

5

Island engaged in teaching duties, including support personnel whose positions require a

6

professional certificate issued by the state department of education and personnel licensed by the

7

department of health, or other non-administrative professional employees.

     (b) The standards for the evaluation of personnel shall continue to be under local control

9

pursuant to § 16-2-9, and the method and process for the evaluation of certified teachers shall

10

continue to be a subject matter of collective bargaining pursuant to the provisions of chapter 9.3

11

of title 28.

     (c) A valid and reliable method of calculating student growth and achievement shall be

13

approved by the Rhode Island board of education prior to its use in the evaluation of certified

14

teachers. In no instance shall measures of student growth and achievement be used to evaluate

15

certified teachers prior to July 1, 2019.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would provide that the evaluation of teaching personnel would be pursuant to

2

local control, and that the process for the evaluation for teachers would be a subject to collective

3

bargaining. This act would also provide that measures of student growth and achievement would

4

not be used to evaluate teachers prior to July 1, 2019.

5

     This act would take effect upon passage.
