RELATING TO CRIMINAL PROCEDURE - ARREST | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 12-7-19 of the General Laws in Chapter 12-7 entitled "Arrest" is |
2 | hereby amended to read as follows: |
3 | 12-7-19. Arrest after close pursuit by officers from cities or towns. Stop after close |
4 | pursuit by officers from cities or towns. -- Any member of a duly organized municipal peace |
5 | unit of another city or town of the state who enters any city or town in close pursuit and continues |
6 | within any city or town in such close pursuit of a person in order to arrest stop and briefly detain |
7 | him or her on the ground that he or she has violated the motor vehicle code in the other city or |
8 | town, shall have the same authority to arrest and hold in custody the person as members of a duly |
9 | organized municipal peace unit of any that city or town have to arrest and hold in custody a |
10 | person on the ground that he or she has violated the motor vehicle code in any city or town. |
11 | SECTION 2. This act shall take effect upon passage. |

2 | close pursuit of a person to stop and briefly detain that person for violations of the motor vehicle |
3 | code of the officer's municipality, would have the same authority as members of a duly organized |
4 | municipal peace unit of the city or town entered. |
5 | This act would take effect upon passage. |
