RELATING TO MOTOR AND OTHER VEHICLES - DEALERS', MANUFACTURERS', AND

RENTAL LICENSES

     It is enacted by the General Assembly as follows:

     SECTION 1. Sections 31-5-7, 31-5-8, 31-5-22 and 31-5-34 of the General Laws in

Chapter 31-5 entitled "Dealers', Manufacturers', and Rental Licenses" are hereby amended to read

3

as follows:

     31-5-7. Duration of license. – (a) Application for license shall be made to the

5

department. Licenses shall be valid, unless sooner revoked or suspended, until December 31st of

6

each year for one year and shall be renewable on or before expiration, upon application and

7

payment of the fee required by this chapter.

     (b) Commencing January 1, 2015, licenses shall be valid, unless sooner revoked or

9

suspended, until December 31, 2017, and shall be renewable thereafter every three (3) years.

     31-5-8. License fee. – (a) The license fee for each year shall be as follows: the fee for the

11

license to each motor vehicle dealer shall be three hundred dollars ($300) plus a fee in like

12

amount for each office or branch.

     (b) Commencing January 1, 2015, the license fee for the three-year (3) license duration

14

shall be nine hundred dollars ($900) payable in installments of three hundred dollars ($300) per

15

year.

     31-5-22. Application for license -- Fee -- Expiration. -- (a) Any person desiring to be

17

licensed as a manufacturer, factory representative, or distributor shall apply to the department of

18

revenue upon a form containing any information that the department shall require. The

department may require with the application or, otherwise, information relating to the applicant's

2

solvency, his or her financial standing, or other pertinent matter commensurate with the

3

safeguarding of the public interest, all of which may be considered by the department in

4

determining the fitness of the applicant to engage in the business for which the applicant desires

5

the license.

      (b)(1) Each application of a factory representative shall be accompanied by a fee of one

7

hundred dollars ($100). Commencing January 1, 2015, the factory representative license fee for

8

the three-year (3) license duration shall be three hundred dollars ($300) and shall be payable in

9

installments of one hundred dollars ($100) per year.

     (2) Each application of a manufacturer or distributor shall be accompanied by a fee of

11

three hundred dollars ($300). Commencing January 1, 2015, the manufacturers' or distributors'

12

license fee for the three-year (3) license duration shall be nine hundred dollars ($900) and shall be

13

payable in installments of three hundred dollars ($300) per year.

14

      (c)(1) All licenses shall be granted or refused within thirty (30) days after the application

15

is filed and shall expire, unless revoked or suspended before that time, on December 31st of the

16

calendar year for which they are granted.

17

     (2) Commencing January 1, 2015, licenses shall be valid, unless sooner revoked or

18

suspended, until December 31, 2017 and shall be renewable thereafter every three (3) years.

     31-5-34. Application for license -- Fee -- Expiration. -- (a)(1) Any person, firm, or

20

corporation requiring a license pursuant to this chapter shall apply to the department upon a form

21

specifying any information that the department shall require. The department may require with an

22

application, or otherwise, information relating to the applicant's solvency, his or her or its

23

financial standing, or any other matter which that the department may deem pertinent to

24

safeguard the public interest, all of which may be considered by the department in determining

25

the fitness of the applicant to be licensed pursuant to this chapter. Each application shall be

26

accompanied by a fee of one hundred dollars ($100). All licenses shall be granted or refused

27

within thirty (30) days after the application, and shall expire, unless sooner revoked or suspended,

28

on December 31 of the calendar year for which they are granted.

     (2) Commencing January 1, 2015, licenses shall be valid, unless sooner revoked or

30

suspended, until December 31, 2017, and shall be renewable thereafter every three (3) years.

Commencing January 1, 2015, the license fee for the three-year (3) license duration shall be three

32

hundred dollars ($300) and shall be payable in installments of one hundred dollars ($100) per

33

year.

      (b) Notwithstanding the provisions of any general or public law to the contrary, the

authority to issue licenses for the rental or leasing of motorized bicycles and/or motorized

2

tricycles in the town of New Shoreham shall be vested exclusively in the town council of the

3

town of New Shoreham pursuant to the provisions of chapter 19.3 of title 31.

     SECTION 2. Section 31-3-25 of the General Laws in Chapter 31-3 entitled "Registration

5

of Vehicles" is hereby amended to read as follows:

6

     31-3-25. Issuance of dealer's plates. – (a) The division of motor vehicles shall issue

7

special "dealer's plates" as applied for, which shall have displayed on them the general

8

distinguishing number assigned to the applicant. Each plate so issued shall also contain a number

9

or symbol identifying the plate from every other plate bearing the same general distinguishing

10

number. The division of motor vehicles shall issue dealer's plates every three (3) years in clearly

11

distinguishable colors, one color to be used by new vehicle dealers, another color for used

12

vehicles dealers, and another color for transporter and bailee plates. The color for each category

13

enumerated in this section, shall be changed every three (3) years with the issuance of the plates,

14

and vehicle identification devices will be provided annually.

15

     (b) The dealer plate issuance scheduled for January 1, 2017, shall be deferred until

16

January 1, 2018 to coincide with the dealer license renewal cycle.

17

     SECTION 3. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would allow dealers, manufacturers, distributors and leasing companies to renew

2

their licenses every three (3) years instead of every year. License fees remain unchanged but are

3

allowed to be paid in yearly installments.

4

     This act would take effect upon passage.
