A N   A C T

RELATING TO ALCOHOLIC BEVERAGES - RETAIL LICENSES

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 3-7 of the General Laws entitled "Retail Licenses" is hereby

amended by adding thereto the following section:

     3-7-29. Proof of insurance coverage. – No license under §§ 3-5-1, 3-5-7, and 3-7-1 et

4

seq. for the retail sales of alcoholic beverages shall be issued, transferred, or renewed until the

5

applicant, transferee, or licensee provides proof of mandatory liquor liability insurance coverage

6

by filing a certificate of insurance in a form acceptable to the local licensing authority. As a

7

result, applicants for a liquor license must provide proof of coverage under a liquor liability

8

insurance policy for bodily injury or death for a minimum amount of one million dollars

9

($1,000,000) on account of injury to, or death of, one person, and three million dollars

10

($3,000,000) on account of any one accident resulting in injury to, or death of, more than one

11

person as a condition to receive a retail license under §§ 3-5-1 et seq. and 3-5-7 et seq.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would require proof of liquor liability insurance in order for a license to be

2

issued or renewed for the manufacture, importation, wholesale, or retail sale of alcoholic

3

beverages.

4

     This act would take effect upon passage.
