RELATING TO STATE AFFAIRS AND GOVERNMENT - PUBLIC SAFETY GRANTS

ADMINISTRATION

It is enacted by the General Assembly as follows:

     SECTION 1. Sections 42-26-6 and 42-26-13 of the General Laws in Chapter 42-26

2

entitled "Rhode Island Justice Commission" are hereby amended to read as follows:

3

     42-26-6. Criminal justice policy board -- Appointment of members. -- The criminal

4

justice policy board shall consist of:

5

      (1) The attorney general;

6

      (2) The superintendent of the state police and director of the department of public safety;

7

      (3) The public defender;

8

      (4) The director of the department of corrections;

9

      (5) The director of the department of human services;

10

      (6) The director of the department of behavioral healthcare, developmental disabilities

11

and hospitals;

12

      (7) The chairperson of the state board of regents education;

13

      (8) The director of the department of children, youth, and families;

14

      (9) The chief justice of the family court;

15

      (10) The president of the Rhode Island Police Chiefs Association;

16

      (11) One police chief selected by the Rhode Island Police Chiefs Association;

17

      (12) The chief justice of the Rhode Island Ssupreme Ccourt;

18

      (13) The presiding justice of the superior court;

      (14) The chief judge of the district court;

      (15) The executive director of the Rhode Island League of Cities and Towns;

3

      (16) The director of health;

4

      (17) The director of the division of fire safety;

5

      (18) One university or college faculty member with a research background in criminal

6

justice appointed by the governor;

7

      (19) Four (4) citizens appointed by the governor;

8

      (20) Three (3) representatives appointed by the governor from community service

9

organizations.

     42-26-13. Committee created -- Purpose and composition. -- (a) There is hereby

11

created within the Rhode Island justice commission, pursuant to the provisions of section ยง42-26-

12

7, of this chapter the criminal justice oversight committee for the purpose of maintaining the

13

secure facilities at the adult correctional institutions within their respective population capacities

14

as established by court order, consent decree, or otherwise.

15

      (b) The criminal justice oversight committee (hereinafter referred to as the "committee")

16

shall consist of the following members who shall assemble no less than four (4) times annually or

17

more often at the call of the chairperson or upon petition of a majority of its members:

18

      (1) The presiding justice of the superior court;

19

      (2) The chief judge of the district court;

20

      (3) The attorney general;

21

      (4) The public defender;

22

      (5) The superintendent of state police;

23

      (6) The director of the department of corrections;

24

      (7) The chairperson of the parole board;

25

      (8) The executive director of the Rhode Island justice commission public safety grants

26

administration;

27

      (9) A member of the governor's staff selected by the governor;

28

      (10) Four (4) members of the general assembly, one of whom shall be appointed by the

29

speaker; and one of whom shall be appointed by the president of the senate,; one of whom shall

30

be appointed by the house minority leader; and one of whom shall be appointed by the senate

31

minority leader.

      (11) A qualified elector of this state who shall be appointed by the governor and

33

designated as chairperson of the committee.; and

34

      (12) A member of the Victims' Rights Group, appointed by the speaker of the house.

      Each member of the committee may appoint a permanent designee to attend committee

2

meetings in his/her absence. A quorum at meetings of the committee shall consist of a majority of

3

its current membership.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

ADMINISTRATION

     This act would update various policy board and committee members relative to the Public

2

Safety Grants Administration and would eliminate the requirement that the Criminal Justice

3

Oversight Committee shall assemble no less than four (4) times annually and instead would

4

mandate that it meet annually and allow more meetings if necessary.

5

     This act would take effect upon passage.
