COSMETICIANS, MANICURISTS AND ESTHETICIANS | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 5-10-23 of the General Laws in Chapter 5-10 entitled "Barbers, |
2 | Hairdressers, Cosmeticians, Manicurists and Estheticians" is hereby amended to read as follows: |
3 | 5-10-23. Fixed place of business. -- (a) Manicuring, esthetics, barbering and/or |
4 | hairdressing and cosmetic therapy, as defined in this chapter, shall be practiced only in a shop |
5 | licensed under section 5-10-15. Nothing contained in this chapter shall be construed to prohibit |
6 | the practice of barbering, manicuring, and hairdressing and cosmetic therapy and esthetics in the |
7 | same shop or place of business. |
8 | (b) Nothing in this section shall restrict a hairdresser licensed pursuant to this chapter, |
9 | operating in a licensed nursing service agency, from providing services to an individual who is |
10 | homebound at their home. For purposes of this section, "homebound" is defined as any person |
11 | who is considered housebound for purpose of federal Medicare eligibility. |
12 | (c) Nothing in this section shall restrict any person licensed pursuant to this chapter from |
13 | providing services to an individual who is homebound at their home as verified by a licensed |
14 | health care professional. |
15 | (d) Nothing in this section shall restrict or prohibit any person licensed pursuant to this |
16 | chapter from providing services to an individual residing in any Department of Housing and |
17 | Urban Development (H.U.D.) recognized housing for the elderly in the H.U.D. recognized |
18 | housing in which the individual resides. Those services shall be provided in a separate room |

1 | inspected by the department of health. Students enrolled in programs of hairdressing, barbering |
2 | and/or cosmetology are prohibited in H.U.D. recognized housing. |
3 | (e) Nothing contained in this section shall restrict or prohibit any person, licensed |
4 | pursuant to this chapter, from providing personal services to individuals outside of the salon at |
5 | certain locations, such as homes, mobile units or other venues, for purposes such as weddings and |
6 | fashion photo shoots or the like. The individual provider of these services shall pay an additional |
7 | one hundred dollar ($100.00) fee to the department of health for a separate license to provide |
8 | these services outside of a salon. |
9 | SECTION 2. This act shall take effect upon passage. |
