RELATING TO ANIMALS AND ANIMAL HUSBANDRY -- ANIMAL CARE

It is enacted by the General Assembly as follows:

     SECTION 1. Section 4-19-8 of the General Laws in Chapter 4-19 entitled "Animal Care"

is hereby amended to read as follows:

     4-19-8. Denial of certificates of registration or licenses. – (a) A certificate of

4

registration may be denied to any pound or animal shelter and a license may be denied to any

5

public auction, kennel, pet shop or dealer or, if granted, the certificate or license may be revoked

6

by the director if, after a hearing, it is determined that the housing facilities and/or primary

7

enclosures are inadequate for the purposes of this chapter or if the feeding, watering, sanitizing

8

and housing practices at the pound, animal shelter, public auction, pet shop or kennel are not

9

consistent with the intent of this chapter or with the intent of the rules and regulations which may

10

be promulgated pursuant to the authority of this chapter.

     (b) All animals housed in licensed or registered facilities that have had their license or

12

registration revoked, must be promptly relocated to an approved location in a manner approved

13

by the director of the department of environmental management.

14

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would require the director to promptly approve the new location and the manner

2

of the relocation of animals in facilities that have had their licenses or registration revoked.

3

     This act would take effect upon passage.
