RELATING TO TOWNS AND CITIES - ZONING ORDINANCES

     

     Introduced By: Senators Jabour, Goodwin, Metts, Ruggerio, and Miller

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 45-24-64 of the General Laws in Chapter 45-24 entitled "Zoning

Ordinances" is hereby amended to read as follows:

     45-24-64. Appeals -- Appeals to zoning board of review. -- An appeal to the zoning

4

board of review from a decision of any other zoning enforcement agency or officer may be taken

5

by an aggrieved party. The appeal shall be taken within a reasonable time twenty (20) calendar

6

days of the date of the recording of the decision by the zoning enforcement officer or agency by

7

filing with the officer or agency from whom the appeal is taken and with the zoning board of

8

review a notice of appeal specifying the ground of the appeal. The officer or agency from whom

9

the appeal is taken shall immediately transmit to the zoning board of review all the papers

10

constituting the record upon which the action appealed from was taken. Notice of the appeal shall

11

also be transmitted to the planning board or commission.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO TOWNS AND CITIES - ZONING ORDINANCES

     This act would establish a time certain for filing an appeal to the zoning board of review.

2

It would provide that an appeal from a decision by a zoning enforcement officer or agency shall

3

be taken within twenty (20) calendar days of the date of the recording of the decision. It would

4

further provide for the removal of the current “within a reasonable time” provision.

5

     This act would take effect upon passage.
