RELATING TO TOWNS AND CITIES - ZONING ORDINANCES | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 45-24-64 of the General Laws in Chapter 45-24 entitled "Zoning |
2 | Ordinances" is hereby amended to read as follows: |
3 | 45-24-64. Appeals -- Appeals to zoning board of review. -- An appeal to the zoning |
4 | board of review from a decision of any other zoning enforcement agency or officer may be taken |
5 | by an aggrieved party. The appeal shall be taken within a reasonable time twenty (20) calendar |
6 | days of the date of the recording of the decision by the zoning enforcement officer or agency by |
7 | filing with the officer or agency from whom the appeal is taken and with the zoning board of |
8 | review a notice of appeal specifying the ground of the appeal. The officer or agency from whom |
9 | the appeal is taken shall immediately transmit to the zoning board of review all the papers |
10 | constituting the record upon which the action appealed from was taken. Notice of the appeal shall |
11 | also be transmitted to the planning board or commission. |
12 | SECTION 2. This act shall take effect on January 1, 2015. |

1 | This act would establish a time certain for filing an appeal to the zoning board of review. |
2 | It would provide that an appeal from a decision by a zoning enforcement officer or agency shall |
3 | be taken within twenty (20) calendar days of the date of the recording of the decision. It would |
4 | further provide for the removal of the current “within a reasonable time” provision. |
5 | This act would take effect on January 1, 2015. |
