RELATING TO BUSINESS AND PROFESSIONS -- PHARMACIES--COMPOUNDED

PRESCRIPTION LABELING

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 5-19.1 of the General Laws entitled "Pharmacies" is hereby

amended by adding thereto the following section:

     5-19.1-32. Compounded drugs used in office. -- (a) Prescription drugs that are not

4

commercially available may be compounded for physician's office use, but shall not be resold.

All compounding shall be done in compliance with the United States Pharmacopeia and as

6

defined by the board.

     (b) Upon request, a pharmacy shall provide a compounded drug to a practitioner for

8

administration in a physician's office. The compounded drug shall be for practitioner

9

administration only and shall not be redispensed, pursuant to ยง 5-19.1-21. The practitioner shall

10

not be required to provide the name of an individual patient in order for the pharmacy to dispense

11

the compounded drug, and the pharmacy shall include the statement "Not for resale. For office

12

use only" on the label of any such compounded drug. The pharmacy shall maintain records to

13

indicate what compounded drug products the pharmacy provided to the practitioner.

14

     SECTION 2. This act shall take effect upon passage.
