A N   A C T

RELATING TO MOTOR AND MOTOR VEHICLES - RESIDENTS

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 31-1-18 of the General Laws in Chapter 31-1 entitled "Definitions

and General Code Provisions" is hereby amended to read as follows:

     31-1-18. Resident and nonresident. -- (a) "Nonresident" means any person who is not a

resident of this state or is temporarily residing in this state as a student or as a member of the

armed forces of the United States.

      (b) "Resident" means a person:

      (1) Who owns, rents, or leases real estate within the state as his or her residence and:

Whose legal residence is the state of Rhode Island, and:

      (i) Engages in a trade, business, or profession in this state; or Who engages in intrastate

business and operates in such a business any motor vehicle, trailer, or semitrailer, or any person

maintaining such vehicles in this state, as the home state of such vehicles; or

     (ii) Who physically resides in this state and engages in a trade, profession, occupation, or

accepts gainful employment in this state; or

      (ii) (iii) Enrolls his or her children in a school in this state for a period exceeding ninety

(90) days; or

      (2) Who is registered to vote or is eligible to register to vote under the laws of this state.

Who declares that he or she is a resident of this state to obtain privileges not ordinarily extended

to nonresidents of this state.

     (3) The term does not include a person who is an actual tourist, an out-of-state student, a

foreign exchange student, or a seasonal resident.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO MOTOR AND MOTOR VEHICLES - RESIDENTS

     This act would make changes to the definition of the term "resident" for purposes of the

motor vehicle code and includes those who do business in the state or intrastate or declares Rhode

Island his or her residence.

     This act would take effect upon passage.
