RELATING TO PUBLIC OFFICERS AND EMPLOYEES -- RHODE ISLAND PUBLIC

EMPLOYEE PENSION REVOCATION AND REDUCTION ACT

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 36-10.1 of the General Laws entitled "Rhode Island Public

Employee Pension Revocation and Reduction Act" is hereby amended by adding thereto the

following section:

     36-10.1-5. Municipal employee pension revocation and reduction. – The superior

court shall have jurisdiction to review any decisions, appeals or other proceedings initiated

pursuant to any municipal ordinance providing for the revocation or reduction of the pension of

any municipal employee for circumstances constituting dishonorable service as defined by

municipal ordinances.

     SECTION 2. This act shall take effect upon passage and shall apply to all pending

proceedings under any municipal ordinance as provided herein.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO PUBLIC OFFICERS AND EMPLOYEES -- RHODE ISLAND PUBLIC

EMPLOYEE PENSION REVOCATION AND REDUCTION ACT

     This act would provide that the superior court would have jurisdiction to review any

decisions, appeals, or other proceedings, initiated pursuant to any municipal ordinance, providing

for the revocation or reduction of the pension of any municipal employee under circumstances

constituting dishonorable service, as defined within said ordinances.

     This act would take effect upon passage would apply to all proceedings pending as of the

date of passage.
