J O I N T   R E S O L U T I O N

CREATING A SPECIAL LEGISLATIVE COMMISSION TO STUDY MOTOR FUEL TAX

     RESOLVED, That a special legislative commission be and the same is hereby created

2

consisting of eight (8) members; four (4) of whom shall be members of the House of

3

Representatives, not more than three (3) from the same political party, to be appointed by the

4

Speaker of the House; and four (4) of whom shall be members of the Senate, not more than three

5

(3) from the same political party, to be appointed by the President of the Senate.

     In lieu of any appointment of a member of the legislature to a permanent advisory

7

commission, a legislative study commission, or any commission created by a General Assembly

8

resolution, the appointing authority may appoint a member of the general public to serve in lieu

9

of a legislator, provided that the Majority Leader or the Minority Leader of the political party

10

which is entitled to the appointment, consents to the member of the general public.

     The purpose of said commission shall be to review, monitor, and make a comprehensive

12

study and report on all areas of the motor fuel tax and shall seek ways to devise and implement a

13

replacement for the motor vehicle fuel tax and make recommendations on the feasibility of

14

replacing said tax.

     Forthwith upon passage of this resolution, the members of the commission shall meet at

16

the call of the Speaker of the House and the President of the Senate and organize. The Speaker of

17

the House shall select a member of the House and the President of the Senate shall select a

18

member of the Senate to serve as co-chairpersons. Upon selection of co-chairpersons, the

19

commission shall meet at least quarterly.

     The membership of said commission shall receive no compensation for their services.

     All departments and agencies of the state shall furnish such advice and information,

2

documentary and otherwise, to said commission and its agents as is deemed necessary or

3

desirable by the commission to facilitate the purposes of this resolution.

     The Joint Committee on Legislative Services is hereby authorized and directed to provide

5

suitable quarters for said commission; and be it further

6

     RESOLVED, That the commission shall report its findings and recommendations to the

7

General Assembly no later than March 1, 2015, and said commission shall expire on May 1,

8

2015.

     This resolution would create an eight (8) member special legislative study commission

whose purpose it would be to study and make recommendations on the elimination of the motor

3

fuel tax, and who would report back to the General Assembly no later than March 1, 2015, and

4

whose life would expire on May 1, 2015.
