A N   A C T

RELATING TO CRIMINAL PROCEDURE -- IDENTIFICATION AND APPREHENSION OF

CRIMINALS

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 12-1 of the General Laws entitled "Identification and Apprehension

of Criminals" is hereby amended by adding thereto the following section:

     12-1-11.1. Maintenance and distribution of photographs and descriptive

information as to persons convicted of certain offenses. – (a) In the case of every individual

who has been found guilty and sentenced, or has pleaded guilty or otherwise been convicted, of

any offense listed in §§ 11-8-1, 11-8-1.1, 11-8-2, 11-8-2.1, 11-8-2.2, 11-8-2.3, 11-8-2.4, 11-39-1,

11-39-2, 11-41-7, or 31-9-2, any photographs and descriptive information compiled by the

attorney general pursuant to § 12-1-11 shall be duplicated and provided to the police department

or law enforcement agency which arrested the individual for that criminal offense.

     (b) Any photographs and descriptive information provided by the attorney general

pursuant to the provisions of subsection (a) of this section shall be maintained by the arresting

police department or law enforcement agency, and shall be publicly displayed by that police

department or agency at public places and buildings, including, but not limited to, all nonprofit

and other neighborhood organizations in the community in which the offense occurred.

     (c) No photographs or descriptive information shall be distributed pursuant to the

provisions of subsection (b) of this section, until such time as all appeals have been exhausted and

the underlying criminal conviction is upheld.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO CRIMINAL PROCEDURE -- IDENTIFICATION AND APPREHENSION OF

CRIMINALS

     This act would establish a community notification system in which descriptive

information of an individual convicted of certain offenses would be distributed in the community

where the offense has occurred.

     This act would take effect upon passage.
