A N   A C T

RELATING TO WATERS AND NAVIGATION - HARBORS AND HARBOR LINES

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 46-4 of the General Laws entitled "Harbors and Harbor Lines" is

hereby amended by adding thereto the following sections:

     46-4-9. Regulation of moorings. – (a) In the granting of mooring space, priority shall be

4

granted to persons applying for mooring space within any municipality as follows:

5

     (1) First priority shall be granted to residents of the municipality which has jurisdiction

6

over the mooring;

7

     (2) Second priority shall be granted to residents of the state who are not residents of the

8

municipality which has jurisdiction over the mooring;

9

     (3) Third priority shall be granted to the owners of the various marinas or yacht clubs

10

which are located within the jurisdiction of the mooring; and

11

     (4) Fourth priority shall be granted to out-of-state residents.

     46-4-10. Annual mooring fee schedule. – (a) The following fee schedule shall apply to

13

all moorings under the jurisdiction of Rhode Island municipalities:

14

     (1) Mooring for vessels from zero to five hundred pounds (500 lbs.) shall be one hundred

15

fifty dollars ($150) per mooring;

16

     (2) Mooring for vessels from five hundred pounds (500 lbs.) to one thousand pounds

17

(1,000 lbs.) shall be two hundred fifty dollars ($250) per mooring; and

18

     (3) Mooring for all vessels over one thousand pounds (1,000 lbs.) shall be five hundred

19

dollars ($500) per mooring.

     (b) All fees collected pursuant to this section shall be allocated to the department of

2

environmental management for the sole use of maintaining all harbors' access and safety. No

3

portion of any fee paid pursuant to this chapter shall be used for any purpose other than

4

maintenance of the harbor and service to the users of the moorings.

     (c) Any municipality that violates the provisions of this section shall be guilty of a civil

6

violation to be administered by the department of environmental management, and subject to a

7

fine not to exceed one hundred dollars ($100) for a first violation, and up to two hundred fifty

8

dollars ($250) for any subsequent violation.

     SECTION 2. This act shall take effect upon passage.
