RELATING TO HUMAN SERVICES - MEDICAL ASSISTANCE FRAUD

     Introduced By: Representatives Morgan, Chippendale, Reilly, Filippi, and Giarrusso

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 40-8.2-7 of the General Laws in Chapter 40-8.2 entitled "Medical

Assistance Fraud" is hereby amended to read as follows:

     40-8.2-7. False statements made to gain certification. -- Whoever knowingly and

willfully makes or causes to be made, or induces, or seeks to induce the making of any false

statement or representation of a material fact with respect to the conditions or operation of any

institution or facility in order that the institution or facility may qualify (either upon initial

certification or upon recertification) as a hospital, skilled nursing facility, intermediate care

facility, or home health agency, shall be guilty of a misdemeanor and, upon conviction thereof,

shall be fined not more than five hundred dollars ($500) one thousand dollars ($1,000) or

imprisoned for not more than six (6) months one year, or both.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO HUMAN SERVICES - MEDICAL ASSISTANCE FRAUD

     This act would increase the penalties from $500 and up to six (6) months incarceration to

$1,000 and a year incarceration for making a false statement of a material fact with respect to the

conditions or operation of any institution or facility in order that such institution may qualify as a

hospital, nursing facility, intermediate care facility or home health agency.

     This act would take effect upon passage.
